By creating an account, placing a call, or otherwise using Boses.ai (the "Service"), you agree to these Terms & Conditions and to our Privacy Policy. If you do not agree, you must not use the Service. You must be at least eighteen (18) years old to use the Service.

Boses lets a user (a "Sender") send an anonymous voice message (a "Call") to another person (a "Recipient"). The Call is delivered by an artificial-intelligence voice character and tells the Recipient that someone admires them, together with clues about the Sender’s identity. Recipients may, if they choose, hear the Call, view the clues, share content, play a guessing game, and request further clues. Boses does not disclose the Sender’s identity to the Recipient. Only the Sender may choose to reveal it.

You represent and warrant that you are at least eighteen (18) years old and have the legal capacity to enter into these Terms. The Service may only be used to send Calls to Recipients who are also at least eighteen (18) years old.

This Section is fundamental to your right to use the Service. By placing a Call, you (the Sender) represent, warrant, and undertake that:

• You have a reasonable and good-faith belief that the Recipient would welcome the Call;
• The Recipient is at least eighteen (18) years old;
• You are not subject to any protection order, temporary or permanent restraining order, or similar legal restriction in respect of the Recipient;
• You have the lawful right to provide the Recipient’s personal information to us for the purpose of delivering the Call, and you authorize us to process it for that purpose on your instruction;
• You will not use the Service to harass, stalk, intimidate, threaten, coerce, blackmail, deceive, defame, shame, or cause distress to any person;
• You will not use the Service in violation of any applicable law of the Republic of the Philippines, including Republic Act No. 10173 (Data Privacy Act of 2012), Republic Act No. 11313 (Safe Spaces Act), Republic Act No. 9262 (Anti-Violence Against Women and Their Children Act), Republic Act No. 4200 (Anti-Wiretapping Law), and Republic Act No. 10175 (Cybercrime Prevention Act);
• You are solely responsible for the content, intent, and consequences of every Call you send; and
• You will indemnify and hold us harmless in respect of your use of the Service and any breach of these warranties, as set out in Section 9.

You must not, and must not allow any other person to:

• Send a Call to any person under eighteen (18) years of age;
• Use the Service to harass, harm, or distress any person;
• Send a Call to a Recipient who has opted out, or whom you have reason to believe does not wish to receive it;
• Attempt to discover, defeat, reverse-engineer, or circumvent the anonymity, security, or rate-limiting features of the Service;
• Use any automated means to send Calls at scale, or otherwise abuse, overload, or interfere with the Service;
• Impersonate any person or misrepresent your identity or affiliation;
• Use the Service for commercial solicitation, advertising, spam, or fraud.

We may suspend or terminate any account, refuse service, and remove any content at our discretion for any breach of these Terms.

If you receive a Call, you are under no obligation to use the Service or to create an account. You may permanently opt out of receiving any further Calls at any time, using the opt-out method indicated in the message accompanying the Call or on our website (/opt-out). Once you opt out, your number is added to a permanent suppression list and no further Calls will be delivered to it by any Sender. You may also request deletion of your personal data as described in the Privacy Policy.

A core feature of the Service is that we do not reveal the Sender’s identity to the Recipient. Only the Sender may choose to reveal it. We do not, however, guarantee anonymity against lawful process. We may disclose a Sender’s identity and related information where required by law, by court or regulatory order, or in response to a verified report of abuse, harassment, or harm, and we may cooperate with law enforcement accordingly.

The Service is currently offered free of charge during our launch period. We reserve the right to introduce fees, paid features, credit-based usage, or subscription charges in the future, on reasonable notice through the Service. Any free or promotional allowance (including any "credits" granted during the launch period) is provided at our discretion, is not transferable or redeemable for cash, and may be modified or withdrawn when the launch period ends. Your continued use of the Service after a change to fees takes effect constitutes your acceptance of that change.

You agree to indemnify, defend, and hold harmless Boses, Arbolo AI Inc., and its officers, directors, employees, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or in connection with: (a) your use or misuse of the Service; (b) your breach of these Terms or of any warranty you have given; or (c) your violation of any law or of the rights of any third party, including any Recipient.

The Service is provided on an "as is" and "as available" basis, without warranties of any kind except those that cannot be excluded under Philippine law. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or exemplary damages, nor for any harm arising from the acts or omissions of any Sender, Recipient, or third party using the Service.

We may suspend or terminate your access to the Service at any time, with or without notice, for breach of these Terms, suspected abuse, or where required by law. Where we receive a verified report of abuse, we may retain your identifying information as described in the Privacy Policy and cooperate with the appropriate authorities, including the PNP Anti-Cybercrime Group.

We may amend these Terms from time to time. We will notify you of material changes through the Service. Your continued use after the changes take effect constitutes acceptance.

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines.
